LICENCE AGREEMENT

THIS LICENCE AGREEMENT made this_____day of________2000 BETWEEN Claycastle Mobile Home Park Youghal County Cork (hereinafter called the Licensor which expression shall where the context so admits or requires include its successors and assigns) of the one part and

(hereinafter called the Licensee) of the other part.

NOW THIS AGREEMENT WITNESSES AS FOLLOWS

1. That the Licensor for the consideration agrees to grant unto the Licensee the Licence hereinafter stipulated in respect of part of the licensors Caravan Site at Claycastle Youghal, County Cork and known as Site No: on the Licensors Development map.

2. Subject as hereinbefore proved the Licensee can gain entry and have the right for the period from the signing of the within Agreement to the 31st of December, 2000 to enter upon the said Caravan Park for the purpose of thereon siting, positioning, placing and maintaining in place a mobile caravan upon wheels suitable for use as a temporary private residence.

3. The Licence hereby covenants with the Licensor as follows:

(a) To pay the Licensor in consideration for the Licence hereinbefore granted a sum of which details of amount and payment will be conveyed in writing to the licensee. If rent is not paid in full by Easter of the current year the Licence Agreement can, at the option of the Licensor, be revoked forthwith and the Licensee shall not be reimbursed any monies already paid.

(b) To maintain the mobile caravan in respect of which the Licence is granted in good repair and condition and in particular shall maintain and keep attached to the caravan fully inflated wheels such as will enable the caravan to be moved or removed at any time. The valuation of the caravan shall be in excess of £4500. In this regard the Licensors valuation shall be final and binding.

(c) Not to erect upon the said lands in respect of which the licence is granted or on any other lands of the Licensor any fixtures, fittings whatsoever of a permanent or temporary nature and in particular shall not undertake any works which will constitute a development within the meaning of the Local Government (Planning and Development) Act, 1963 to 1983 or any other form of development whatsoever without the express consent of the licensor. Any such permitted works or development can only be carried out by a qualified contractor who holds appropriate insurance cover indemnifying the licensor. In particular for the purpose of clarification the Licensee agrees that he or she shall not plant any shrubs, flowers, trees, bushes of any kind whatsoever within the lands in respect of which the Licence is granted or on any other lands without the Licensor's consent.

(d) Not to bring into or keep upon the lands or in the Caravan the subject of the licence, any dog, cat or any other household pet or any other animal of any nature whatsoever.

(e) To use the caravan as hereinbefore mentioned for the purpose only of a private residence and shall not use same for any other purpose whatsoever and in particular shall not use such caravan for any business purposes.

(f) Licence agreements, or sites are not transferable, the Licence herein granted shall be personal unto him/her and the Licensee shall not assign the benefit of the agreement in respect of which the licence is granted. The Licence hereby covenants that the persons named in the Schedule hereafter are the members of the Licensee's family entitled to reside in the Licensee's caravan. On request, at any time, the Licensee shall furnish to the Licensor any signatures or additional details of all persons residing in the Licensee caravan.

(g) SUBLETTING OF CARAVANS IS STRICTLY PROHIBITED

(h) Not to use the caravan hereinbefore mentioned or the lands in respect of which the Licence is granted in such manner as to cause or permit any nuisance, annoyance or inconvenience to the Licensor or to the owners of adjoining or adjacent caravans and in particular agrees that radios, tape recorders, musical instruments, portable televisions and other like instruments of entertainment shall not be played outside the caravan hereinbefore mentioned and further shall not be played inside the caravan hereinbefore mentioned in such a manner as to emit excessive noise or such as would constitute a nuisance, annoyance or inconvenience to the Licensor or the owners of any adjoining or adjacent caravan. The Licensee or any member of his family as specified in the Schedule hereto shall not engage in any unnecessary driving of any vehicle within any part of the Caravan Park, all reasonable attempts shall be made to minimize vehicle noise and the speed limit of 5 MPH must be observed.

(i) Not to bring upon the land in respect of which the Licence is granted or permits to be brought upon such lands any pedal cycle, push bike, motor cycle, or any other form of two wheeled vehicle or velocipede.

(j) Not to hang or allow to be hung from any clothes line any clothes or any other articles for drying or for any purpose whatsoever or to expose the same within the confines of the site in respect of which the Licence is granted in the manner permitted and specified by the Licensor. Not to permit clothes or any other articles to be left outdoors at night.

  1. Any children including teenagers residing in the caravan shall be properly supervised and that a sufficient number of adults shall be available for the purpose of supervision and that such children and teenagers shall not be permitted to do anything which would cause a nuisance, annoyance or inconvenience to the Licensor or the owner of any adjoining or adjacent caravan. Climbing on buildings and trees, throwing stones, interfering with or trespassing on any neighboring properties is absolutely prohibited.

(l) To dispose of all household refuse and other litter in accordance with the direction of the Licensor and that Licensee agrees that he shall not allow such household refuse or litter to accumulate within the caravan or on the site in respect of which the Licence is granted. The Licensee shall provide a satisfactory bin for disposal of all his/her domestic litter and rubbish and there shall be a satisfactory bin liner in each bin and sealed bin liners shall be placed at such position on the property at such intervals as the Licensor shall determine

(m) To keep the licensed site (to include its surrounds and area underneath the caravan) in a state of good order, condition and hygiene and not to store any materials under or around the caravan and in particular not to allow grass or weeds to grow under the caravan around entrance steps and driveway of the licensed site.

(n) Not to use weed control sprays of any kind without the prior consent of the licensor.

(o) To keep the caravan on the licensed site properly stabilized at all times which obligation shall extend to securely fastening the said caravan against the elements.

(p) Each caravan must carry a Comprehensive Insurance Policy to cover the caravan its contents and third party liability.

(q) Not to bring, suffer, permit or use any commercial vehicle i

(r) Not to cause, suffer or permit any ball game, including tennis, hurling, football or any games whatsoever to be played anywhere on the park.

(s) To turn off the water at the main under the caravan and to turn off the electricity supply in the event of same being vacated for any period of two days and upwards.

(t) To keep the plumbing (water and sewage) connections free from leaks and obstructions at all times. The use of garden hoses for any purpose is strictly prohibited.

(u) Not to force into any part of the ground the subject matter of licence or any part of the Licensors property any stake or object whatsoever without the prior consent of the Licensor.

(v) Not to erect any television aerials on the caravan or any part of the licensed property without the prior consent of the Licensor.

(w) Not to have more than one cylinder of gas on any part of the licensed property or part of the Licensors property at any time.

(x) Not to place any sign of a commercial nature on the licensed property or any part of the Licensors property.

(y) Not to allow unauthorised persons to use your access key or allow any misuse by any persons residing in your caravan.(4) The Licensee hereby acknowledges that he or she is responsible for the conduct of all the residents in the Licensee's caravan

at any time. The Licensee is responsible for the conduct and safety of his or her invites and the Licensee hereby

acknowledges that the Licensor bears no responsibility for or has no liability to the Licensee invites. The Licensee further

acknowledges that the Licensor has no responsibility for and hereby indemnifies the Licensor against all proceedings, actions,

claims and, liability whatsoever arising out of negligence, breach of duty or breach of statutory duty of the Licensee, his

servants, agents or invites PROVIDED ALWAYS and it is hereby agreed as follows:(a) The Licensor shall be entitled to terminate the licence herein granted for breach of any condition herebefore mentioned or any

reason whatsoever upon giving seven previous days notice in writing to that effect to the Licensee. Such notice in writing shall

be deemed to be effectively served if given to the Licensee or left at the caravan of the Licensee on the site licensed. The

Licensor shall not be obliged to furnish any reason for such termination to the Licensee. In the event of the Licence being

terminated by such notice then the Licensee shall be entitled to refund of such proportionate amount of the annual licence fee

paid as the unexpired term of the licence year bears to a full calendar year. (b) The Licensor shall be entitled to make rules and regulations for the Management of the Caravan Park in which the area, the

subject matter of the licence is situate. The Licensee shall obey all such rules and regulations.(c) In the event of notice being given to terminate the licence as hereinbefore provided, and in the event that the caravan is not

removed from the site by the Licensee within the time specified on such notice,then the Licensor shall be free to remove or

cause to be removed at the expense of the Licensee the caravan from the site licensed to a place to be selected by the

Licensor. The Licensee further agrees that such removal shall be at the sole risk of the Licensee and that the Licensor shall

not be responsible for any damage to the caravan howsoever caused in course of such removal. The Licensee shall indemnify

the Licensor against all costs of such removal and shall pay all storage charges incurred in respect of said caravan.(d) A fee will have to be paid in the event of the licensee requiring their caravan to be sold on the site and the consent of the

licensor is required and the subsequent purchaser must complete an application form and be accepted by the licensor before

any sale takes place.(e) Caravans sold privately off site must be moved from the site within 7 days.(5) The Licensee further agrees to indemnify the Licensor against all claims whatsoever, whether in contract or in sort of otherwise

by any persons arising out of the use of the caravan hereinbefore mentioned.(6) The licensee hereby acknowledges that he or she has examined the sites facilities and is aware of the location, dimension and

physical aspect of same before executing the within agreement.
