The Safety, Health and Welfare at Work Bill 2004 as published on the 24th of June also states that Codes of Practice exist for the purpose of regulating safety and other procedures and activities. A failure to observe a Code of Practice, which leads to an accident and subsequent prosecution, will be admissible as evidence in court.

 

 
 

The implications for companies and persons responsible for ensuring compliance with the above statutory instrument are immense and legally binding. As in all Health & Safety legislation, ignorance of the actual law is no defence for non-compliance.



 

Legislation

Electrical Equipment Testing is now a legal requirement for all employers and service providers in Ireland. Various policies cover this requirement including General Application Regulation 1993 Part2, Part 8.36 and Parts 4.20. Statutory Instrument 44.

Legislation that came into Law on May 2nd 2001, Statutory Instrument 188, states
“…in the case of work equipment which is exposed to conditions causing deterioration liable to result in a danger to safety or health…

(ii) periodic inspection, and where appropriate testing must be carried out.”
(iii) Safety and health conditions are maintained and deterioration is detected and remedied in good time;

j) The results of inspections carried out under paragraphs (h) and (i) are recorded and kept available for inspection by inspectors of the Authority for five years from the date of inspection;
k) When work equipment is used in another place of work, it is accompanied by evidence of the last inspection carried out under paragraphs (h) and (i);
l) Inspections carried out under paragraphs (h) and (i) are carried out by a competent person and are appropriate to the nature, location and use of the work equipment;”

The Safety, Health and Welfare at Work Act (General Application)(Amendment) Regulations, 2001 places an obligation that due diligence be shown in ensuring safety of equipment in the following circumstances:
(i) Where electrical equipment or tools are used by employees.
(ii) Where the public may use appliances in premises such as schools, hotels, shops, B&B’s etc.
(iii) Where appliances are supplied or hired.
(iv) Where appliances are repaired or serviced.
