Please ensure you read and understand the following terms and conditions. If you have any queries, please do not hesitate to contact us for clarification before you sign the booking form.

Whiles we reserve the right to amend our prices at any time, we will confirm you the current price at the time of booking. As soon as we have confirmed your reservation, the price of the rental is guaranteed. This guarantee is offered subject to our terms and conditions.

Terms and Conditions

CONTRACT
A contract exists when the owners, have received the deposit and signed booking form and confirmed your booking in writing/email. This contract is between the property owners and the lead guest who must sign the booking form accepting these terms and conditions on behalf of all persons named on the booking form, including those substituted or added by agreed amendment of the booking.

Authorized Guests
The lead guest must be a member of the Party occupying the property and must be over 21 years of age.The lead guest, by signing the booking form, certifies that he or she authorized to agree the booking terms and conditions on behalf of all persons included on the booking form, including those substituted or added by agreed amendment with the property owners at a later date.  Only those persons listed on the booking form are authorized to use the property. Any changes to the persons booked to occupy the house must be notified to and confirmed to the owners before occupancy commences ( this is to comply with State Law)
The lead guest is required to disclose on the booking form the age of any guests under 21 years or under.Maximum number of guest is 10 persons

Alterations to confirmed booking
All requests to alter a confirmed booking must be made by lead guest in writing and must be confirmed by owners in writhing. Whilst the owners will try to accommodate any request to alter a confirmed booking (subject to availability) we make no guarantee that any alteration will be possible. If an alteration is not possible and the lead guest decides to cancel – the cancellation charges will apply.

Insurance
We strongly advise that all guests have appropriate travel/holiday insurance in force from the time of booking, for the total duration of the trip. Please insure the policy includes cancellation charge cover. All non US guests are also advised to have a policy that gives adequate medical cover for the US.

Please be aware that if you choose not to take out insurance, you, the lead guest, will be personally responsible for payment of any cancellation charges which may become due.

BOOKINGS
On receipt of your booking request, we will send a booking confirmation, this will provide you with the information necessary to make your payment, and confirm your booking. We will post your provisional booking on our Availability Chart page within five working days of sending the booking confirmation to you, your party then has 14 days to pay the due amount in order to confirm your booking.

In the event that we do not receive your payment within 14 days, we will regrettably remove your provisional booking from our Availability Chart page. A booking only becomes confirmed on receipt and clearance of your deposit payment to us.

PAYMENT
A non refundable deposit payment of 20% of the full rental sum (excluding pool heat & security deposit) is due at the time of booking confirmation in order to confirm your booking. On receipt of your deposit payment, we will send a letter to confirm our receipt of your deposit. We then bank the cheque and wait for clearance. On clearance of the deposit payment into our account, we will send out a receipt.

SECURITY DEPOSIT
Security deposit of US$300/GB£250 will be charged eight weeks prior to the start date of the rental, this will be held by the owners against loss or damage occasioned by the use of the property to the parties to this agreement. The deposit will be fully refunded by the owners 28 days after the completion of the holiday subject to a satisfactory damage/loss report being received from our Management Company and all Terms and Conditions being adhered to. The lead guest agrees to pay any additional charges for damage or loss not covered by the security deposit. The owners or Management Company reserve the right to recover such costs by any means available to them.

Payment of the final rental, pool heat (where applicable), plus the refundable security deposit, is due eight weeks prior to your arrival date, or before. On receipt, banking and clearance of your party's final payment, we will send out arrival details, directions, maps and key collection information.

Payments must be made by Cheque/Bank Draft/International Money Order. We cannot accept credit card payments, due to the surcharge levied by the credit card companies, which we would have to pass onto our guests. We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date, cancellation charges will then apply.

CANCELLATION
Any cancellation of a booking must be made in writing to the property owners by the lead guest and is subject to the following charges:
More than eight weeks prior to your arrival date – full deposit
Less than eight weeks prior to your arrival date- 100% of the total rental cost.

In the unlikely event that the owners, due to circumstances beyond their control, have to cancel the booking, the owners will endeavor to locate a suitable alternative villa. Should the owners be unable to locate an alternative villa or if the alternative villa is not acceptable, the lead guest will receive a complete refund of all monies by them, to the owners. However the owners will not be liable for any other loss, consequential or otherwise, incurred by the lead guest or any other member of the party.

FORCE MAJEURE
The owners of the property will not be liable for loss or delay occasioned by any of the following: Strikes, Riots, Political unrest, Hostilities, War or treat of War, Terrorist activity, Adverse weather conditions, Closure of Airports or any other event beyond the owners control.

CHECK-IN AND CHECK-OUT TIMES
Arrival at the property must be after 4.00 pm local time. The property must be vacated by 10.00 am on the date of departure. (Unless otherwise advised to you in writing)

YOUR RESPONSIBILITIES
The lead guest is required to check the property and facilities thoroughly and report any damage or missing items within 24 hours of check in. Any loss or damage not reported within this time will be responsibility of the lead guest and charged for accordingly.                                                                                                                                                                                

The party must treat the property; its furnishings, fixtures & fittings, utensils and other facilities with respect. Any loss, damage or problems relating to the property or its contents must be reported to the management company immediately. The Management company will endeavor to replace or rectify any loss or damage to the property or its contents, or resolve any problems you may have as soon as practically possible.

The lead Guest must make good or pay for any loss, damage or breakage. The owners reserve the right to withhold any monies from security deposit to pay for any loss or damage caused to the property or its contents by any member of the party. The lead guest agrees to pay any additional charges for damage or loss not covered by the security deposit. The owners reserve the rights to recover such costs by any means available to them.

For security of your party and the villa, do not allow any unidentified visitors to enter the villa. If in any doubt please call the Management Company to check the identity and authorization of any maintenance/pest control staff.

The villa is protected by a Rampart Alarm system, this acts as burglar alarm. Therefore it is required that the lead guest makes all members of the their group aware that all doors and windows must be locked, including garage door, front door and 2 doors leading to the pool area and alarm activated when ever the villa is left unattended.

When checking out of the villa for the final time please ensure that; all doors and windows are locked, including garage door, front door and 2 doors leading to the pool area. The alarm is activated and the key is returned to the lock box.

It is very important that these instructions are followed even if the cleaners or anybody else is waiting to gain access to the villa. All authorized housekeeping and maintenance staffs are in possession of keys and appropriate codes for gaining access to the villa. Do not give keys or codes to anybody.

BBQ                                                                                                                                                                                               
A gas BBQ is provided for our guests to use while staying at our villa. Cleaning the grill is not the responsibility of the cleaning company team. Do not at any time leave the grill unattended when in use. Do not leave food on the grill after use as this will attract unwanted pests and wild animals. Please keep the grill covered when not in use. Failure to clean the BBQ will incur an £35/$50 cleaning charge from your security deposit, Please leave the BBQ as you would wish to find it. Keeping the tank filled is not the responsibility of the owners or management company.

SWIMMING POOL                                                                                                                                                                        
The property has a swimming pool. Swimming pool and surrounding areas are potentially dangerous. Guests are specifically requested not to allow children to use the pool area unsupervised, nor to swim unaccompanied and not to swim under the influence of alcohol, medication or other mind altering substances. The owners do not accept any liability for any accident, injury or death, however caused, as a result of the use at the pool area.

For safety and comfort the pool is inspected, cleaned and if necessary, chemically balanced every week. The pool staff does not need to gain access to the interior of the villa to carry out his maintenance. On rae occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it may be necessary for all guests to refrain from using the pool for a period specified by the pool cleaning company's agent – this is a normal part of pool maintenance.

CLEANING AND TRASH
The property will be cleaned and checked prior to you arrival and after you have departed. Should you require mid stay cleaning this can be arranged and paid for locally with the Management Company. Although the property will be cleaned after your departure it must still be left in an orderly state and all kitchen utensils should be washed. Should to property require extensive cleaning the owners reserve the right to withhold any monies from the security deposit to pay for the extra cleaning.

Trash collections are twice per week, the actual days are listed in the owner's manual in the property. The trash must be placed in trash bags and securely tied before being placed in the bins. The bins must be placed at the end of the property's drive close to the road on the evening before collection – the bins must be returned to the garage by the evening of collection day. The county can and do impose HEAVY fines for loose trash and bins not returned to the garage. If any member of you party violates the county trash laws the lead guest will be liable for fines incurred.

CLIMATE
Florida is a tropical climate and as such is the home of many insects etc. Our home is treated on a regular basis to repel such unwanted visitors. But inevitably they will find their way inside the property. They are best eradicated by spraying with an appropriate product. The problem with these unwanted guests is greatly reduced if food and crumbs are not left on worktops, tables, floors, or in the pool area – it is advisable to clean up spills immediately.

POOL HEAT
Pool heat is charged as an optional extra. The pool heat thermostat is set to heat the water in the pool at approximately 85 degrees; however the pool blanket must be used at all times when the pool is not in use. Like you we have no control over the weather! We are unable to guarantee the ware temperature with pool heating as this will depend on the prevailing weather conditions.

The pool heater is a mechanical device, and can be subject to occasional failure. If such a breakdown was to happen, every effort will be made to repair the heater as quickly as possible. We will only refund the amount that the guest has paid for the pool heat for the days that the heater is not working.

DSL (internet access)
The villa is equipped with a DSL connection for our guests to use while on vacation, if you choose to bring your own lap top. DSL modem is in the kitchen area, please be sure to leave DSL modem in the house on your departure. This will be checked after every guest leaves.

SMOKING AND PETS                                                                                                                                                                   
We have a strict no smoking policy inside the house. Guests are welcome to smoke on the pool deck, provided that ashtrays are used and stubs/butts are carefully disposed of. If the management Company finds any evidence if smoking inside the house during your stay, this will be regarded as a serious breach of contract and you will be evicted immediately. All monies paid will forfeited and you will be liable for a deep clean fee- this will include but is not limited to, professional cleaning of all soft furnishings, linens, carpets ect as well as a “clean air” fee, to replace all air conditioning filters and de-odorizing costs. We have a stricked no pets policy.

VEHICLES AND PARKING
In accordance with the Calabay Parc Homeowners Association rules, no truck or van, boat, trailer, recreational vehicle, commercial vehicle or other types of non passenger vehicles, equipment, implements or accessories shall be parked, stored or otherwise kept on any portion of the property or elsewhere on Calabay Parc.

ACCESS
Whilst guests privacy is respected, the owners management company reserves the right to gain access to the property at any time.

COMPLAINTS                                                                                                                                                                               We sincerely hope you do not have any!! But in the unlikely event that you experience a problem relating to the property, this must be reported to the management company immediately to allow them to try and rectify the problem. If a satisfactory solution is nit achieved within 24 hours, we ask that you put the complaint in writing to the management company and also contact us, preferably by email, with a copy of the complaint within 48 hours of the complaint arising so that we have the opportunity to respond as soon as possible. Unless there are exceptional circumstances, we will not consider the owner or management company liable for any complaint that was not initially registered with our management company during your stay.

LIABILITY
The owner or management company do not accept any liability for accidents, loss, injury or death, or for any such claim by a third party caused as a consequence of actions by any authorized guests or other unauthorized person(S) present at the property. Guests are specifically requested to supervise children at all times.

BREACH OF CONTRACT
Failure to comply with any of the terms and conditions by any member of the party may result in your booking being cancelled/terminated. In such circumstance all monies paid will be forfeited and the owners or management company accept no liability for any consequential loss incurred by any guest.

Please Note:
No booking will be confirmed until your booking form has been fully signed and returned, and your deposit has been paid in full.
