I, ANDREW C, of Ballycastle, County Letrim, Republic of Ireland, do make, publish and declare this to be my Last Will and Testament, hereby revoking all wills and codicils at any time heretofore made by me.
FIRST: A. I give and bequeath to my mother Mei C, if she survives me, 50% of my share holdings in CWC Property and Estate Company Ltd, if owned by me at the time of my death, and my house in Conduit Road, if owned by me at the time of my death.
B. I give and bequeath to my sister, Ching C, my brother, John C, and my sister-in-law, Agnes K, my remaining share holdings in CWC Property and Estate Company Ltd, if owned by me at the time of my death, to be divided between them by my Executors, named hereinunder, in the exercise of sole and absolute discretion, in as nearly equal portions as may be practicable.
C. Within a period of twelve (12) months from the date of my death, any interests discalaimed by my sister, my brother or my sister-in-law pursuant to this Paragraph B of Article FIRST shall be sold and the net proceeds of sale shall be given to any qualified charitable beneficiaries with the purposes of providing medical care to children in Africa, as my Executors, in the exercise of sole and absolute discretion, shall select.
D. I give and bequeath to my brother-in-law, Willie C, my Porsche 911 and my entire wine collection, if owned by me at the time of my death, in appreciation of his generosity.
E. I give and bequeath to my sister, Ching C, my Mercedes C36 and my entire crystal collection, if owned by me at the time of my death, in apology for the things that I have not done as a brother in my lifetime.
F. My entire share holding in CWC Porcelainware Co Ltd and my apartment in Downsview shall be sold and the proceeds of sale shall be given and distributed equally amongst my friends, K K Tsui, M K Cheung and C F Yip in appreciation of their trust.
SECOND: A. I APPOINT my sister Ching C and my sister-in-law, Agnes K to be the Executors and Trustees of this my Will.
B. Except as hereinabove otherwise effectively bequeathed, I GIVE free of inheritance tax all my tangible property and assets of every kind to my Executors jointly (or if only one of them shall prove my Will to her),
C. I do NOT WISH to be buried.
D. Should any child of mine be under age at the date of the death of the survivor of myself and my wife I APPOINT my sister Ching C, and my sister-in-law Agnes K to be the guardians of that child and I express the wish that should I predecease my wife she will consult with my sister and my sister-in-law with regard to the upbringing education and welfare of our children.
E. For the purposes of any distribution pursant to this Article B to appropriate all or any part of my said property and assets in or toward satisfaction of any share in my residuary estate without needing the consent of anyone.
THIRD: A. I have made no provision in this my Will for my wife, Trudy K, for whom I onced loved. I do wish, however, to remember her as mother of my children and, thus, I direct my Executors to set aside the amount of Two Million Euros (€2,000,000), if she survives me, and I give and bequeath the sum so set aside to the Trustees hereinafter named, IN TRUST, NEVERTHELESS, to hold the same, and to manage, invest and reinvest the same, to collect the income thereof and to dispose of the net income and principal for the following uses and purposes and subject to the following terms and conditions:
1. Payment of Annuity Amount. The Trustees shall hold and manage the trust property for a term (the "trust term") which shall commence with the date of my death and shall end on the Fifteenth (l5th) anniversary thereof. At the end of each taxable year of the trust during the trust term, the Trustees shall pay a annual maintenance fee of 5% of the initial trust value to my wife.
2. Upon the expiry of the trust term, the trust created under this Article THIRD shall terminate, and the Trustees shall thereupon transfer, convey and pay over the trust assets, as they are then constituted to my then surviving children, Jennifer, Kathleen and Ellen, in equal proportion.
